1. Definitions

  • "App" — the Tale Boo mobile and web application, featuring the character "Boo"
  • "Provider", "we", "us" — Mente Spółka Akcyjna (Mente S.A.), ul. Pl. Zwycięstwa 2, 90-312 Łódź, Poland; KRS: 0001044782, Tax ID (NIP): 7282875373, REGON: 525942709
  • "User", "Parent" — an adult (18+) who has created an account in the App as a parent or legal guardian
  • "Child" — a child aged 3–12 whose profile was created by a Parent and who uses the App under the Parent's supervision
  • "Content" — stories, text, audio recordings, and other materials generated within the App

2. Who may use the App

Only an adult who is the parent or legal guardian of the child for whom they are creating a profile may create an account. By creating an account, the Parent represents that they:

  • are at least 18 years old,
  • are the parent or legal guardian of the child/children for whom they create profiles,
  • have read and accept these Terms and the Privacy Policy,
  • if cloning another person's voice (e.g. a grandmother's) — have that person's consent to use their voice within the App.

Children use the App only under the Parent's supervision and do not create their own, independent accounts.

3. Description of the service

The App enables the creation of personalized, educational bedtime stories for children based on ideas provided by the child, using generative AI for text and speech synthesis. The App includes built-in content moderation, usage limits, and parental control features (PIN, privacy settings).

Disclaimer regarding AI-generated content: Story content is generated automatically by AI systems. Despite built-in safety filters, we do not guarantee that every generated piece of content will be error-free or fully align with the Parent's expectations. We encourage co-experiencing the App with your child, especially early on.

4. Plans, subscriptions, and payments

  • The App offers a free plan (limited number of stories per week) and a paid Premium plan (extended features: more stories, premium voices, voice cloning).
  • Prices and plan details are shown in the App before purchase.
  • Subscriptions purchased in the app on Apple devices (iOS/iPadOS) are billed by Apple (In-App Purchase), and on Android devices by Google (Google Play Billing), subject to those stores' terms and pricing. Payments in the web version are handled by a third-party payment provider (Stripe). Renewals, cancellations, and refunds for store purchases are governed by the respective Apple or Google terms.
  • Promo codes may be used subject to their individual terms as shown in the App.
  • Right of withdrawal: EU consumers have the right to withdraw from a distance contract within 14 days under applicable consumer protection law. Where digital content (e.g. a story) is delivered before that period expires, with the Parent's explicit consent and acknowledgment that this waives the right of withdrawal, that right may expire earlier, in accordance with applicable law. (To be finalized by counsel, particularly with regard to the EU Digital Content Directive.)

5. Content and intellectual property

  • The Parent retains rights to the ideas and topics submitted by the child.
  • We grant the Parent a license to use generated stories for personal and family use (including printing for personal use, where that feature is available).
  • Publishing a story to the App's public gallery (an optional feature, off by default) grants us a limited license to display that story to other App users, for the scope and duration set by the Parent in privacy settings.
  • Using the App to generate unlawful content, content that infringes third-party rights, or content unsafe for children is prohibited — such attempts may be automatically blocked by safety filters.
  • Voice cloning: the Parent is responsible for obtaining consent from the person whose voice is being cloned. Cloning a person's voice without their knowledge and consent — including public figures' voices for deceptive purposes — is prohibited.

6. Acceptable use

The User agrees to:

  • use the App as intended and in accordance with applicable law,
  • not attempt to circumvent content moderation and safety filters,
  • not use the App for unlawful purposes or purposes harmful to children,
  • provide appropriate supervision of the child's use of the App.

7. Reporting inappropriate content

If, despite our safeguards, the App generates content you find concerning, please report it to: rodo@taleboo.com. Every report is treated as a priority and used to further improve our safety filters.

8. Limitation of liability

To the extent permitted by applicable law, we are not liable for content automatically generated by AI systems, which — despite safeguards — may contain inaccuracies. The App does not replace parental supervision. (The scope and limits of any liability disclaimer — including as against consumers — require refinement by counsel under applicable law, as certain liability limitations cannot be effectively excluded as against consumers.)

9. Termination

The Parent may delete their App account at any time (Settings → Privacy → "Delete account forever"), resulting in permanent data deletion as described in the Privacy Policy. We reserve the right to suspend or terminate an account that violates these Terms, in particular attempts to generate content harmful to children.

10. Governing law and dispute resolution

These Terms are governed by the laws of Poland, without prejudice to mandatory consumer protection laws of the User's country of residence. EU consumers may use the European Commission's Online Dispute Resolution (ODR) platform: ec.europa.eu/consumers/odr. (This section requires refinement by counsel based on target markets.)

11. Changes to these Terms

We will notify you of material changes to these Terms with reasonable advance notice before they take effect.
